Aloha Takes Mesa to Federal Court

Aloha Airlines says it is pursuing further legal action against Mesa Air Group in federal district court. Aloha in October 2006 sued Mesa in state circuit court, contending that Mesa used confidential Aloha information to compete in Hawaii's inter-island air market in an unethical manner. Aloha also says that Mesa has sold the tickets of its Hawaii operation, Go!, at below cost in an attempt to drive Aloha out of business. Although the carrier can pursue its claims in both federal and state courts, it has decided to move forward solely on the federal level. Aloha decided to file in federal court after further review of the federal antitrust laws, as well as the findings of federal Bankruptcy Judge Robert Faris in Hawaiian Airlines' filing against Mesa. Faris was the judge who presided during both Honolulu-based legacy carriers' progress through and departure from bankruptcy in recent years.
