JoyStar Faces Involuntary Bankruptcy Petition by Agents

Several TravelStar/JoyStar travel agents have filed a Chapter 7, involuntary petition for bankruptcy against TravelStar d/b/a JoyStar for unpaid commissions due them, according to Peter Slilphen, Coral Sands Travel. In an interview with Travel Agent, Stilphen reports that Drew Axelrod, an agent who claims to be owed over $35,000 by JoyStar, filed the petition on December 31, 2008 in the Southern District of Florida's United States Bankruptcy Court. (Case # 08-30191-RBR.)  JoyStar will have 20 days after receipt of the petition to respond and the petition names 15 JoyStar agents claiming to be owed more than $150,000 in commissions since April 2008. Additional petitioners will be added after receipt of the court creditor declaration attesting to the amount owed them by JoyStar.

According to Stilphen, the travel agent group is asking the Bankruptcy Court to step in and take control of JoyStar's assets in hopes of eventually getting paid their commissions. Stilphen said Axelrod has a growing list of over 50 agents who claim to have not been paid their commissions. He hopes that other JoyStar agents will now come forward. It was felt that this action was necessary because no one has been able to contact JoyStar/TravelStar president and CEO William Alverson and there are concerns that JoyStar funds could be diverted in another direction, Stilphen said.

Axelrod, according to Stilphen, is asking the agents themselves and others in the travel industry to make a donation to the legal fund to defray upfront costs. “If sufficient assets are found the court will be asked that the legal fees be returned to those that have donated," Stilphen said. "As CEO of Coral Sands Travel and a strong advocate of the travel agent, I will contribute to this legal expense fund. I do hope other travel agents, my fellow host agencies, the organizations and suppliers will do the same.”

Stilphen, a staunch advocate of agents, urges all JoyStar travel agents who have legitimate claims for unpaid commissions should send details to Axelrod as soon as possible. Stilphen also urges a 5 percent contribution to the legal fund. “I doubt that creating chat rooms where you can call Alverson et al names and write about how much you have been hurt by this and filing small claims actions in your local court or just doing nothing will get your commissions paid,” Stilphen said. He also urged action by industry associations, suppliers and former TravelStar/JoyStar employees and shareholders to act. At press time neither Alverson or Axelrod were availible for comment.

    I worked for Joystar at their 'headquarters' for a number of years not because I liked the job BUT because it was better than no job at the time. They not only stiffed the agents, but they robbed the employees as well. I was unaware of the bankruptcy until August of this year and wish I had known of it. I have some knowledge that possibly could have helped the agents get their money back.

    I left joystar because both Kathy and Bill are cheats and liars who spent more time partying and playing than trying to run a business. I witnessed this first-hand!

    For those of you still in the industry, be advised this is NOT the first time Bill Alverson has pulled this scam on the travel industry at large - He has the big million dollar home in Newport Beach, house in Park City, Utah and other toys to prove it.

    My question is: Why has not anyone hired a top notch PI to get the goods on them, The trail is there is someone would just look!

    I gave Tand B tours $475.00 FOR A TOUR TO NIAGARA FALLS ON SEPT.18-21 2008 FOR MY WIFE&I.TANDB TOURS CANCELED,AND SAID THEY COULD NOT GET THE MONEY BACK FROM JOY STAR TRAVEL WHOM THEY SAID THEY BOOKED THE TOUR WITH.HOW DO I GO ABOUT GETTING MY MONEY BACK?I AM RETIRED AND NEED THE MONEY

    The lawyer for the creditors issued a statement saying it's unlikely that we will see a Dime because all assets where taken. This is unbeleivable Bill gets away again. How come he dont go to jail this should be a criminal matter.

    If you want to know where your money is, ask Drew Axelrod. I've been in this business for over 30 years and I can't believe Drew Nimrod, is able to steal from his fellow professionals. If you total up whats owed to agents, it seems awfully close to what Drew owes TravelStar. First off, I will NEVER allow any of my customers or worst enemies interact with Drew again! Being in travel and dance, I have to say that I'm taken back by the abbrassive attitude this man has towards others. When I read that TravelStar was receiving threatening calls from Drew, I knew that it is the same Drew that I had problems with. After 3 of my customers complained about his attitude and I had experienced it myself, I stopped working with him. When I tried to confront him, he FLIPPED OFF THE HANDLE! Any man threatening physical violence to a woman is SCUM!

    we need to band together:
    all those support associations truly dont care for us independents however few do. we should all set up our own accounts with vendors that care:

    MLT vacations
    Happy Vacations
    Classic Vacations
    Sabre vacation suite

    and thats just to name a few.
    Do your own deals and do not book with vendors that require ARC/IATAN #
    Come on and give your voice $$$$ they will come and listen.
    call if you need help and we should have a network to help each other. I am tired of people building the houses on my b ack and scaming the independents.

    While I have not invested the huge amounts of money that Doug M has, nor lost thousands on commissions as the numerous travel agents have, I also feel cheated, jaded, and fairly stupid for getting involved even on a small scale. Money used to invest in Travelstar is gone, investment in stock is gone, commission is gone. Do these people not believe that the harm they do will come back to them?
