YTB Faces Legal Action in California for Illegal Pyramid Scheme

In a move that will be welcomed by many professional travel agents, California Attorney General Edmund G. Brown Jr. has sued YourTravelBiz.com for operating a gigantic pyramid scheme. The state alleges that YTB “recruited tens of thousands of members with deceptive claims that members could earn huge sums of money through its online travel agencies.” If found guilty, YTB could face fines and restitution as high as  $25 million.

“YourTravelBiz.com operates a gigantic pyramid scheme that is immensely profitable to a few individuals on top and a complete rip-off for most everyone else,” Attorney General Brown charged. “Today’s lawsuit seeks to shut down the company’s unlawful operation before more people are exploited by the scam.”

Brown charges the company, its affiliates and the company’s founders J. Lloyd Tomer, J. Scott Tomer, J. Kim Sorensen and Andrew Cauthen with operating an “endless chain scheme,” an unlawful pyramid in which a person pays money for the chance to receive money by recruiting new members to join the pyramid.

Brown also charges the company with unfair business practices and false advertising practices including  deceptive claims that members can earn millions of dollars with the company, operating without filing legally mandated documents with the attorney general and the Department of Corporations and selling an illegal travel discount program.

John Frenaye, a veteran agent and critic of YTB, said the state’s move was a “decisive win for travel agents and the travel industry” and could go a “long way to end the multilevel marketing challenge to the industry.” Last year, Frenaye collected more than 2,700 signatures from agents and suppliers opposing multilevel marketing.

In a statement, the attorney general said YourTravelBiz.com and its affiliates operate an illegal pyramid scheme that only benefits members if and when they find enough new members to join the scam. “Once enrolled, members who join the pyramid scheme earn compensation for each new person they enlist, regardless of whether they sell any travel. The company lures new members by offering huge income opportunities through online travel agencies, yet the typical person actually makes nothing selling travel.

“According to company records, there were over 200,000 members in 2007 who typically pay more than $1,000 per year—$449.95 to set up an 'online travel agency' with a monthly fee of $49.95. In 2007, only 38 percent of the company’s members made any travel commissions. For the minority of members who made any travel commission in 2007, the median income was $39—less than one month’s cost to keep the website. There are at least 139,000 of the company’s travel websites, all virtually identical, on the Internet.”

YourTravelBiz’s extensive marketing materials include videos of people driving Porsches and other luxury cars, holding $10,000 checks and claiming to be raking in millions of dollars in profits. The company advertises through its Website, www.ytb.com, and at conventions, workshops and nationwide sales meetings that have been held in California locations such as Los Angeles, Sacramento, San Francisco and San Diego.

Under California’s unfair business practices statute, the company is liable for $2,500 per violation of law, the statement said. “Attorney General Brown is suing YourTravelBiz.com to get a court order that: Bars the company from making false or misleading statements and assesses a civil penalty of at least $15,000,000 and at least $10,000,000 in restitution for Californians who were ripped off by the company.”

The Attorney General’s statement also noted that from August 6 through 10, “thousands of members are preparing to travel to St. Louis for a national convention to learn new techniques to recruit more victims into the illegal pyramid scheme. Last year at least 10,000 people attended a similar national conference.”

    World Travel Deminsions ran many travel agent fam trips for years. People with YTB id cards were told they could participate in travel agent fam trips. We turned down many applicants as they needed to have an IATA card for legimate fam trips.

    Now I believe that YTB is integrty oriented. It offers you a website that Barry Dillard payed billions for orbitz.com. Yes guess what folks its not a get rich quick thing you actually have to work. I am so happy that I have found YTB. Its an awsome Co.

    I was a ytb rta for 3 years. I was very interested in the travel portion of this mlm. I was not into selling all my friends the YTB business that most were not interested in. The probem was that the commissions on even very high priced tickets weren't that great. They were about $10.00. I wasn't even making my $50.00 website payment back. So, finally I decided it was time to close the website down. The prices were comprable to travelocity or expedia except for interenational travel which was my specialty. SO, I stilll help my friends look for tickets, but without paying $50.00 a month and I don't get $10.00 commission. I am happy. I would have been happier had the commission been more especially for such high priced tickets to China, London etc.

    Yes, I felt that it was a scam. I once booked a cruise for approx. 9 ladies for Mother's Day. I never earned a comission check as promised. I did receive a comission check for 10 cents if I remember correctly. I booked the cruise just to see if I would earn what YTB said " I would earn" After that I with drew from being a YTB agent and told my sister n law that it was a pyramid scam.

    There are some ignorant people in the world.

    You just can't please everyone. 

    Now you get someone that wants to sue for his own political gain and every tom, dick and harry that hasn't really worked for anything in their life wants to jump on board.

    Listen! ITS A BUSINESS OPPORTUNITY! And guess what? You have to work.

    If you wanted a McDonald's franchise, you'd have to spend at least $1 million dollars. Do you think that if you didn't profit is a week, that they'd give you your money back.

    Some of the problems that people have are simply that they want their money back. They think they're buying a tv or a dress at Walmart and that they can use and abuse it for 30 days and on the 30th day get their money back. They're living in an instant gratification world and if they are gratified immediately, they want they're money back.

    Grow up! They get a 5 day money back guarantee and really that shouldn't even be in place. But it's there to satis

    I am wondering about the people who complain about YTB... who are they really? people will always complain... about anything, about everything...

    I have finally found a good company with integrity; YTB. I joined YTB but wasn't interested in the marketing side of it. I just wanted to sell travel. But I have friends that wanted to sell travel too so they joined. We sell travel and we make money with our sales. The money is there if you work. People not making money are the ones who don't do anything and don't sell travel. You have to put efforts in it like you would do at your job or anything you want to see results. Period.

    Unfortunately, there are people that always want to put others down in order to succeed. So YTB is going through a lawsuit... I am not surprised... so did many companies trying to succeed. That is just the way it is.

    I support YTB because I know that they are full of integrity and are doing the right thing.

    YTB and every other LEGITIMATE multilevel marketing company is just like an exercise machine.... It only works if you use it. What is different about YTB is that there are two sides. If you never recruit anyone you can still sell travel and make money doing it. I haven't paid 49.95 since I started because I simply got the six people necessary to avoid that fee. Everything YTB has claimed it will do IT HAS DONE. I am sorry that they have to go through this, but that's the cost to be the best. Unfortunately David wouldn't be known without Goliath. The bottom line is you get out of ANYTHING YOU DO .. the effort and follow-through that you put in to it.
